Terms and Conditions
The following terms and conditions are applicable to the entity purchasing Gift PPIs/PPIs ("Customer" or “you”) through Braveheart Labs India Private Limited (“Braveheart”) a company incorporated under the Indian Laws and having its registered office at SF-650, 6th Floor, JMD Megapolis, Sohna Road, Gurugram, Haryana 122018.
All Gift PPIs shall be valid for a period as per the terms decided and set out by Braveheart or the respective brand owners. “Gift PPI” shall mean PPIs issued in physical or electronic form in accordance with Section 10.1 of the Master Direction on Issuance and Operation of Prepaid Payment Instruments read with the Payment and Settlement Systems Act, 2007 (“RBI Master Directions”). These Cards are not reloadable in nature. “PPIs” means Prepaid Instruments issued under the RBI Master Directions.
The Gift PPIs shall be redeemable on zeffo.in or any other websites and locations set out in these Terms and Conditions.
Customer is aware, understands and acknowledges that, by redeeming the Gift Card, the beneficiary agrees to these terms and conditions.
Customer is aware, understands and acknowledges that a Gift PPI cannot be exchanged for its value in cash, either in full or in part. Customer further acknowledges that the value stored/loaded in a Gift PPI cannot be refunded or cannot be transferred in any manner whatsoever.
Under no circumstances whatsoever, is the return of Gift PPIs permitted under this Agreement once the same have been generated and delivered to Customer.
Gift PPIs are not subject to GST as per current tax law.
The Company is required to maintain the beneficiary details of all customers who procure such Gift PPIs and all beneficiaries who receive and/or redeem the Gift PPIs/ PPIs for a minimum period of 10 years (first name and last name of the beneficiary, email id and phone number). This information is to be maintained as mandated under the provisions of the Prevention of Money Laundering Act, 2002, the rules notified thereunder and the Reserve Bank of India (RBI) guidelines on Anti Money Laundering and in view of the Policy Guidelines for issuance and operation of Prepaid Payment Instruments in India issued by RBI and other ancillary applicable law. The Company also undertakes to share such beneficiary details whenever requested by Pine Labs/Reserve Bank of India/or any other regulatory authority.
Governing Law and Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of India. Customer and Company agree to submit to the exclusive jurisdiction of the courts at Gurgaon, Haryana. You agree to indemnify the Company for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these terms and conditions.
Limitation of Liability: BRAVEHEART LABS DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY WILL BE THE REPLACEMENT OF SUCH GIFT CARD. IF APPLICABLE LAW DOES NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Customer shall indemnify, defend and hold harmless Company from and against any and all third-party liability, losses, costs and expenses (including reasonable attorney’s fees) relating to or arising out of the breach of these terms and conditions, the negligence or wilful misconduct by the Customer, or its employees or agents. Company reserves the right to change these Terms and Conditions from time to time in its discretion and without prior notice to you. All terms and conditions are applicable to the extent permitted by law.
